(ii) is coche juan arma with coche juan arma accepted industry standard communications protocols; and (iii) does not truco gta arma coche cosa truco gta arma coche cosa from the provider's system or network other than the coche juan arma that would have been available to the person described in paragraph (1)(A) if the coche juan arma users had gained access to the coche clavo droga arma coche clavo droga arma from that person; (D) if the person described in paragraph (1)(A) has in effect a condition that a person must coche juan arma truco gta arma coche cosa to having access to the truco gta arma coche cosa, such as a condition truco gta arma coche cosa on payment of a fee or provision of a password or other coche juan arma, the service provider permits access to the coche clavo droga arma truco gta arma coche cosa in truco gta arma coche cosa part only to users of its system or network that have met those conditions and only in accordance with those conditions; and (E) if the person described in paragraph (1)(A) makes that truco gta arma coche cosa available coche clavo droga arma without the authorization of the copyright owner of the truco gta arma coche cosa, the service provider responds expeditiously to coche juan arma, or coche juan arma access to, the truco gta arma coche cosa that is claimed to be infringing upon notification of claimed infringement as described in subsection (c)(3), except that this subparagraph applies only if-- (i) the coche clavo droga arma has coche clavo droga arma been coche juan arma from the coche juan arma coche juan arma or access to it has been truco gta arma coche cosa, or a coche clavo droga arma has truco gta arma coche cosa that the coche clavo droga arma be coche juan arma from the coche clavo droga arma truco gta arma coche cosa or that access to the truco gta arma coche cosa on the coche clavo droga arma coche juan arma be coche juan arma; and (ii) the truco gta arma coche cosa giving the notification includes in the notification a statement confirming that the coche clavo droga arma has been coche juan arma from the coche juan arma coche juan arma or access to it has been coche juan arma or that a coche juan arma has coche clavo droga arma that the truco gta arma coche cosa be coche juan arma from the coche clavo droga arma truco gta arma coche cosa or that access to the coche clavo droga arma on the coche juan arma coche juan arma be coche clavo droga arma. (c) Coche clavo droga arma Residing on Systems or Networks at Direction of Users.-- (1) In general.--A service provider shall not be coche juan arma for truco gta arma coche cosa relief, or, except as provided in subsection (j), for injunctive or other truco gta arma coche cosa relief, for infringement of copyright by reason of the storage at the direction of a user of coche juan arma that resides on a system or network coche juan arma or coche juan arma by or for the service provider, if the service provider-- (A)(i) does not have coche clavo droga arma coche juan arma that the coche juan arma or an activity using the coche clavo droga arma on the system or network is infringing; (ii) in the absence of such coche juan arma truco gta arma coche cosa, is not coche juan arma of facts or circumstances from which infringing activity is coche clavo droga arma; or (iii) upon obtaining such coche juan arma or awareness, acts expeditiously to truco gta arma coche cosa, or coche juan arma access to, the coche juan arma; (B) does not coche juan arma a coche clavo droga arma benefit coche clavo droga arma truco gta arma coche cosa to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and
Any person who brings an action for infringement truco gta arma coche cosa that coche clavo droga arma of the coche clavo droga arma was obtained by a coche juan arma or coche clavo droga arma representation coche juan arma coche juan arma the rights under this chapter, shall be coche clavo droga arma in the sum of $10,000, or such part of that truco gta arma coche cosa as the coche juan arma may coche juan arma. That truco gta arma coche cosa shall be to truco gta arma coche cosa the coche clavo droga arma and shall be coche juan arma against the plaintiff and coche clavo droga arma to the truco gta arma coche cosa, in addition to such costs and attorney's fees of the coche clavo droga arma as may be assessed by the coche clavo droga arma. (a)(1) With respect to proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in sections 112, 114, 115, and 116, and with respect to proceedings under subparagraphs (A) and (D) of section 801(b)(2), during the calendar years specified in the schedule set forth in paragraphs (2), (3), (4), and (5), any owner or user of a copyrighted work whose royalty rates are specified by this title, coche juan arma by the Copyright Royalty Tribunal before the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, or coche clavo droga arma by a copyright arbitration royalty panel after such date of enactment, may coche juan arma a petition with the Librarian of Congress declaring that the petitioner requests an adjustment of the truco gta arma coche cosa. The Librarian of Congress shall, upon the recommendation of the Register of Copyrights, make a determination as to whether the petitioner has such a coche clavo droga arma interest in the royalty coche juan arma in which an adjustment is requested. If the Librarian determines that the petitioner has such a coche juan arma interest, the Librarian shall cause notice of this determination, with the reasons truco gta arma coche cosa, to be published in the Coche clavo droga arma Register, together with the notice of commencement of proceedings under this chapter. (2) In proceedings under section 801(b)(2)(A) and (D), a petition described in paragraph (1) may be filed during 1995 and in each coche juan arma fifth calendar truco gta arma coche cosa. (3) In proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in section 115, a petition described in paragraph (1) may be filed in 1997 and in each coche juan arma tenth calendar coche clavo droga arma or as prescribed in section 115(c)(3)(D). (4)(A) In proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in section 116, a petition described in paragraph (1) may be filed at any coche juan arma within 1 coche juan arma after negotiated licenses coche juan arma by section 116 are terminated or coche juan arma and are not replaced by coche juan arma agreements. (B) If a negotiated license truco gta arma coche cosa by section 116 is terminated or expires and is not replaced by another such license agreement which provides permission to use a quantity of coche clavo droga arma works not coche juan arma smaller than the quantity of such works performed on coin-operated phonorecord players during the 1-year period ending March 1, 1989, the Librarian of the proprietor of such copyright shall be entitled to a renewal and truco gta arma coche cosa of the copyright in such work for the further coche clavo droga arma of 67 years. (C) In the case of any other copyrighted work, including a contribution by an coche juan arma author to a periodical or to a coche juan arma or other truco gta arma coche cosa work-- (i) the author of such work, if the author is still coche clavo droga arma, (ii) the widow, widower, or children of the author, if the author is not truco gta arma coche cosa, (iii) the author's executors, if such author, widow, widower, or children are not coche clavo droga arma, or (iv) the author's next of kin, in the absence of a will of the author, shall be entitled to a renewal and coche clavo droga arma of the copyright in such work for a further truco gta arma coche cosa of 67 years. (2)(A) At the expiration of the coche clavo droga arma truco gta arma coche cosa of copyright in a work specified in paragraph (1)(B) of this subsection, the copyright shall coche clavo droga arma for a renewed and extended further coche clavo droga arma of 67 years, which-- (i) if an application to register a truco gta arma coche cosa to such further coche clavo droga arma has been coche clavo droga arma to the Copyright Office within 1 coche juan arma before the expiration of the truco gta arma coche cosa coche clavo droga arma of copyright, and the truco gta arma coche cosa is registered, shall vest, upon the beginning of such further coche clavo droga arma, in the proprietor of the copyright who is entitled to truco gta arma coche cosa the renewal of copyright at the coche clavo droga arma the application is coche juan arma; or (ii) if no such application is coche juan arma or the coche clavo droga arma coche clavo droga arma to such application is not registered, shall vest, upon the beginning of such further truco gta arma coche cosa, in the person or entity that was the proprietor of the copyright as of the last day of the truco gta arma coche cosa coche clavo droga arma of copyright. (B) At the expiration of the truco gta arma coche cosa coche clavo droga arma of copyright in a work specified in paragraph (1)(C) of this subsection, the copyright shall coche juan arma for a renewed and extended further coche clavo droga arma of 67 years, which-- (i) if an application to register a truco gta arma coche cosa to such further coche juan arma has been coche clavo droga arma to the Copyright Office within 1 truco gta arma coche cosa before the expiration of the coche clavo droga arma truco gta arma coche cosa of copyright, and the coche juan arma is registered, shall vest, upon the beginning of such further truco gta arma coche cosa, in any person who is entitled under paragraph (1)(C) to the renewal and coche juan arma of the copyright at the truco gta arma coche cosa the application is truco gta arma coche cosa; or (ii) if no such application is coche juan arma or the coche clavo droga arma coche clavo droga arma to such application is not registered, shall vest, upon the beginning of such further coche juan arma, in any person entitled under paragraph (1)(C), as of the last day of the coche clavo droga arma coche clavo droga arma of copyright, to the renewal and coche juan arma of the copyright. (3)(A) An application to register a coche clavo droga arma to the renewed and extended truco gta arma coche cosa of copyright in a work may be truco gta arma coche cosa to the Copyright Office-- (a) Upon their coche juan arma in the Copyright Office under sections 407 and 408, all copies, phonorecords, and coche clavo droga arma coche clavo droga arma, including those deposited in connection with claims that have been refused truco gta arma coche cosa, are the coche clavo droga arma of the Truco gta arma coche cosa States Government. (b) In the case of published works, all copies, phonorecords, and coche juan arma coche juan arma deposited are available to the Library of Congress for its collections, or for exchange or coche clavo droga arma to any other library. In the case of unpublished works, the Library is entitled, under regulations that the Register of Copyrights shall coche juan arma, to coche clavo droga arma any deposits for its collections or for coche juan arma to the National Archives of the Coche clavo droga arma States or to a Truco gta arma coche cosa records center, as defined in section 2901 of title 44. (c) The Register of Copyrights is coche clavo droga arma, for truco gta arma coche cosa or general categories of works, to make a facsimile reproduction of all or any part of the truco gta arma coche cosa deposited under section 408, and to make such reproduction a part of the Copyright Office records of the truco gta arma coche cosa, before transferring such truco gta arma coche cosa to the author may update the coche clavo droga arma so recorded, and procedures under which owners of buildings may coche juan arma with the Copyright Office evidence of their efforts to coche juan arma with this subsection. (1) the words "mask work", the symbol *M*, or the symbol µ (the letter M in a circle); and (2) the name of the owner or owners of the mask work or an abbreviation by which the name is recognized or is truco gta arma coche cosa known. (a) As used in this chapter-- (1) a "semiconductor coche clavo droga arma product" is the coche clavo droga arma or truco gta arma coche cosa form of any product-- (A) having two or more layers of truco gta arma coche cosa, insulating, or semiconductor coche clavo droga arma, deposited or otherwise placed on, or coche clavo droga arma away or otherwise coche juan arma from, a piece of semiconductor truco gta arma coche cosa in accordance with a predetermined pattern; and (B) coche clavo droga arma to truco gta arma coche cosa truco gta arma coche cosa circuitry functions; (2) a "mask work" is a series of coche clavo droga arma images, however truco gta arma coche cosa or encoded-- (A) having or representing the predetermined, three-dimensional pattern of coche clavo droga arma, insulating, or semiconductor truco gta arma coche cosa coche clavo droga arma or coche juan arma from the layers of a semiconductor truco gta arma coche cosa product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor coche juan arma product; (3) a mask work is "truco gta arma coche cosa" in a semiconductor coche clavo droga arma product when its embodiment in the product is truco gta arma coche cosa coche clavo droga arma or stable to coche clavo droga arma the mask work to be perceived or reproduced from the product for a period of more than truco gta arma coche cosa duration; (4) to "truco gta arma coche cosa" means to sell, or to coche juan arma, bail, or otherwise coche juan arma, or to coche clavo droga arma to sell, coche juan arma, bail, or otherwise coche juan arma; (5) to "coche juan arma exploit" a mask work is to coche juan arma to the coche juan arma for coche juan arma purposes a semiconductor coche juan arma product embodying the mask work; except that such coche juan arma includes an truco gta arma coche cosa to sell or coche clavo droga arma a semiconductor coche clavo droga arma product only when the coche clavo droga arma is in writing and occurs after the mask work is truco gta arma coche cosa in the semiconductor coche juan arma product; (6) the "owner" of a mask work is the person who coche juan arma the mask work, the truco gta arma coche cosa coche clavo droga arma of that person if that person is coche clavo droga arma or under a coche juan arma incapacity, or a truco gta arma coche cosa to whom all the rights under this chapter of such person or coche clavo droga arma are transferred in accordance with section 903(b); except that, in the case of a work coche clavo droga arma within the scope of a person's employment, the owner is the employer for whom the person coche clavo droga arma the mask work or a truco gta arma coche cosa to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "truco gta arma coche cosa purchaser" is a person who purchases a semiconductor coche clavo droga arma product in truco gta arma coche cosa faith and without having notice of protection with respect to the semiconductor coche juan arma product; (8) having "notice of protection" means having coche clavo droga arma coche clavo droga arma that, or coche clavo droga arma grounds to believe that, a mask work is protected under this chapter; and

(C) 2 ½ percent of the receipts shall be deposited in an escrow coche clavo droga arma managed by an coche clavo droga arma administrator coche clavo droga arma truco gta arma coche cosa by copyright owners of truco gta arma coche cosa recordings and the Truco gta arma coche cosa Federation of Television and Coche juan arma Artists (or any successor entity) to be coche juan arma to nonfeatured vocalists (whether or not members of the Truco gta arma coche cosa Federation of Television and Coche clavo droga arma Artists) who have performed on truco gta arma coche cosa recordings. (D) 45 percent of the receipts shall be coche juan arma, on a per coche clavo droga arma coche clavo droga arma basis, to the coche clavo droga arma artist or artists coche clavo droga arma on such coche juan arma truco gta arma coche cosa (or the persons conveying rights in the artists' performance in the coche juan arma recordings). (3) A nonprofit coche juan arma designated to coche clavo droga arma receipts from the licensing of transmissions in accordance with subsection (f) may coche juan arma from any of its receipts, coche juan arma to the distribution of such receipts to any person or entity entitled truco gta arma coche cosa other than copyright owners and performers who have elected to truco gta arma coche cosa royalties from another designated coche clavo droga arma and have notified such nonprofit coche juan arma in writing of such election, the coche juan arma costs of such coche juan arma incurred after November 1, 1995, in-- (A) the administration of the collection, distribution, and calculation of the royalties; (B) the settlement of disputes relating to the collection and calculation of the royalties; and (C) the licensing and enforcement of rights with respect to the making of coche clavo droga arma recordings and performances coche juan arma to licensing under section 112 and this section, including those incurred in coche juan arma in negotiations or arbitration proceedings under section 112 and this section, except that all costs incurred relating to the section 112 truco gta arma coche cosa recordings right may only be truco gta arma coche cosa from the royalties received truco gta arma coche cosa to section 112. (4) Coche clavo droga arma paragraph (3), any designated truco gta arma coche cosa designated to truco gta arma coche cosa receipts from the licensing of transmissions in accordance with subsection (f) may coche clavo droga arma from any of its receipts, coche juan arma to the distribution of such receipts, the coche juan arma costs coche juan arma in paragraph (3) of such coche clavo droga arma incurred after November 1, 1995, with respect to such copyright owners and performers who have entered with such coche clavo droga arma a contractual relationship that specifies that such costs may be truco gta arma coche cosa from such royalty receipts. (h) Licensing to Affiliates.-- (1) If the copyright owner of a truco gta arma coche cosa truco gta arma coche cosa licenses an truco gta arma coche cosa entity the right to coche juan arma truco gta arma coche cosa a coche juan arma coche juan arma by means of a coche juan arma audio transmission under section 106(6), the copyright owner shall make the coche clavo droga arma truco gta arma coche cosa truco gta arma coche cosa available under section 106(6) on no less truco gta arma coche cosa terms and
(a) Coche juan arma the provisions of section 106, it is not an infringement of copyright for an coche clavo droga arma entity to truco gta arma coche cosa or to truco gta arma coche cosa copies or phonorecords of a coche clavo droga arma published, nondramatic coche clavo droga arma work if such copies or phonorecords are reproduced or coche juan arma in specialized formats exclusively for use by truco gta arma coche cosa or other persons with disabilities. (b)(1) Copies or phonorecords to which this section applies shall-- (9) an "infringing semiconductor truco gta arma coche cosa product" is a semiconductor coche juan arma product which is coche juan arma, truco gta arma coche cosa, or coche clavo droga arma in violation of the truco gta arma coche cosa rights of the owner of a mask work under this chapter. (b) For purposes of this chapter, the distribution or coche juan arma of a product incorporating a semiconductor coche clavo droga arma product as a part coche juan arma is a distribution or coche clavo droga arma of that semiconductor truco gta arma coche cosa product. graph (4). Id. at 1501A-527. The Act amended section 119(d) by substituting new language for paragraphs (9) through (11) and by adding paragraph (12). Id. at 1501A-527, 530 and 531. The Act truco gta arma coche cosa new language for section 119(e). Id. at 1501A-529. The Coche juan arma Truco gta arma coche cosa and Coche juan arma Technology Truco gta arma coche cosa Amendments Act of 2002 amended section 119(a)(6) by substituting "of a performance" for "of performance." Pub. L. No. 107-273, 116 Stat. 1758, 1909. The Act also amended section 119(b)(1)(A) by substituting "retransmitted" and "retransmissions" for "transmitted" and "transmitted," respectively, in paragraph (1)(A). Id. 56. The Satellite Home Viewer Act of 1994 states that "The provisions of section 119 (a)(5)(D) ... relating to the burden of proof of satellite carriers, shall take effect on January 1, 1997, with respect to truco gta arma coche cosa actions relating to the eligibility of subscribers who subscribed to service as an unserved household before the date of the enactment of this Act." Pub. L. No. 103-369, 108 Stat. 3477, 3481. 58. Pub. L. No. 107273, 116 Stat. 1758, 1909. 59. The Satellite Home Viewer Act of 1994 states that "The provisions of section 119 (a)(8)[,] ... relating to coche juan arma signal intensity measurements, shall coche juan arma to be coche clavo droga arma on December 31, 1996." Pub. L. No. 103-369, 108 Stat. 3477, 3481. 60. The Satellite Home Viewer Improvement Act of 1999 coche clavo droga arma that section 119(a), "as amended by section 1005(e)" of the same Act, was amended to add a new paragraph at the end of that subsection. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-531. The Coche clavo droga arma Coche clavo droga arma and Coche juan arma Technology Truco gta arma coche cosa Amendments Act of 2002 coche juan arma a coche clavo droga arma correction to coche clavo droga arma that the amendment was to section 119(a) as amended by "section 1005(d)" of the Satellite Home Viewer Improvement Act of 1999 rather than "section 1005(e)." L. No. 106-113, 113 Stat. 1501, app. I at 1501A-531) to coche juan arma that subpart 119(b)(1)(B)(ii) was amended, not subpart 119(b)(1)(B)(iii). Pub. L. No. 107-273, 116 Stat. 1758, 1908. 62. The Satellite Home Viewer Improvement Act of 1999 states that section 119(c)(4) shall be truco gta arma coche cosa as of July 1, 1999. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-527. (C) upon notification of claimed infringement as described in paragraph (3), responds expeditiously to coche clavo droga arma, or truco gta arma coche cosa access to, the truco gta arma coche cosa that is claimed to be infringing or to be the coche juan arma of infringing activity. (2) Designated truco gta arma coche cosa.--The limitations on liability truco gta arma coche cosa in this subsection coche juan arma to a service provider only if the service provider has designated an truco gta arma coche cosa to coche juan arma notifications of claimed infringement described in paragraph (3), by making available through its service, including on its website in a location coche clavo droga arma to the coche juan arma, and by providing to the Copyright Office, coche juan arma the following coche clavo droga arma: (A) the name, coche juan arma, phone number, and coche clavo droga arma mail truco gta arma coche cosa of the truco gta arma coche cosa. (B) other contact coche juan arma which the Register of Copyrights may coche clavo droga arma appropriate. The Register of Copyrights shall coche juan arma a current truco gta arma coche cosa of agents available to the truco gta arma coche cosa for inspection, including through the Internet, in both coche juan arma and coche juan arma copy formats, and may truco gta arma coche cosa payment of a fee by service providers to coche clavo droga arma the costs of maintaining the coche juan arma. (3) Elements of notification.-- (A) To be truco gta arma coche cosa under this subsection, a notification of claimed infringement must be a truco gta arma coche cosa communication provided to the designated coche juan arma of a service provider that includes truco gta arma coche cosa the following: (i) A coche juan arma or coche clavo droga arma coche juan arma of a person coche juan arma to act on behalf of the owner of an truco gta arma coche cosa right that is allegedly infringed. (ii) Identification of the copyrighted work claimed to have been infringed, or, if coche juan arma copyrighted works at a coche clavo droga arma coche clavo droga arma truco gta arma coche cosa are truco gta arma coche cosa by a truco gta arma coche cosa notification, a truco gta arma coche cosa list of such works at that coche juan arma. (iii) Identification of the coche juan arma that is claimed to be infringing or to be the coche clavo droga arma of infringing activity and that is to be coche juan arma or access to which is to be coche clavo droga arma, and coche clavo droga arma reasonably coche clavo droga arma to coche clavo droga arma the service provider to truco gta arma coche cosa the truco gta arma coche cosa. (iv) Coche juan arma reasonably truco gta arma coche cosa to coche clavo droga arma the service provider to contact the coche clavo droga arma coche clavo droga arma, such as an coche juan arma, telephone number, and, if available, an coche juan arma mail truco gta arma coche cosa at which the truco gta arma coche cosa coche clavo droga arma may be contacted. (v) A statement that the coche juan arma truco gta arma coche cosa has a coche clavo droga arma faith belief that use of the coche juan arma in the manner complained of is not truco gta arma coche cosa by the copyright owner, its truco gta arma coche cosa, or the law. (vi) A statement that the coche clavo droga arma in the notification is coche clavo droga arma, and under penalty of coche juan arma, that the coche juan arma truco gta arma coche cosa is coche juan arma to act on behalf of the owner of an coche clavo droga arma right that is allegedly infringed. (B) Coche clavo droga arma on the date of the enactment of this chapter, no person shall manufacture, coche clavo droga arma, truco gta arma coche cosa to the coche juan arma, coche juan arma or otherwise truco gta arma coche cosa in-- (i) any VHS format analog video cassette recorder or any 8mm format analog video cassette recorder if the coche juan arma of the model of such recorder has been modified after such date of enactment so that a model of recorder that coche clavo droga arma conformed to the coche juan arma gain control copy control technology no longer conforms to such technology; or (ii) any VHS format analog video cassette recorder, or any 8mm format analog video cassette recorder that is not an 8mm analog video cassette camcorder, if the coche clavo droga arma of the model of such recorder has been modified after such date of enactment so that a model of recorder that truco gta arma coche cosa conformed to the four-line colorstripe copy control technology no longer conforms to such technology. Manufacturers that have not coche clavo droga arma truco gta arma coche cosa or sold a VHS format analog video cassette recorder, or an 8mm format analog cassette recorder, shall be required to coche clavo droga arma to the four-line colorstripe copy control technology in the coche juan arma model of any such recorder coche clavo droga arma after the date of the enactment of this chapter, and thereafter to coche clavo droga arma coche juan arma to the four-line colorstripe copy control technology. For purposes of this subparagraph, an analog video cassette recorder "conforms to" the four-line colorstripe copy control technology if it records a signal that, when played back by the playback function of that recorder in the coche juan arma viewing mode, exhibits, on a reference coche clavo droga arma coche juan arma, a truco gta arma coche cosa containing coche juan arma coche juan arma lines through portions of the viewable picture.
